BACKGROUND

The Kelo v. New London case arose out of a city’s use of eminent domain to condemn privately owned property as part of its economic redevelopment plan.  The Supreme Court’s landmark decision in Kelo permitted the condemnation proceedings, holding that “economic development” satisfied the 5th Amendment’s “public use” requirement in the exercise of eminent domain.
